Kosovo’s
long
history
with
unrealistic
legal
arrangements
has
contributed
to its
unstable
political
and
social
environments
. From the
Yugoslav
era
Constitutions
to the
most
recent
international
policy
implementation
,
Kosovo’s
legal
basis
has
proven
ineffective
.
It
could
not
build
a
stable
political
system
or
maintain
a
peaceful
society
for the
long-term
. The
main
legal
platforms
that are
discussed
include
: the
Yugoslav
Constitution
of
1963
and
1974
,
UN
Resolution
1244
,
Kosovo
Standards
Implementation
Plan
(KSIP)
,
Ahtisaari’s
Plan
,
Kosovo’s
Declaration
of
Independence
, and
Kosovo’s
Constitution
. To this
day
,
Kosovo’s
independence
claims
are
based
on and
supported
by the
legal
arrangements
that were
set
up
by the
International
Community
. In this
regards
, the
International
Community’s
legal
arrangements
have
contributed
to the
legitimacy
of
Kosovo’s
secession
and
state
formation
.
However
, the
International
Community
still
remains
and
operates
on the
basis
of
pre-independence
international
legislature
. The
Albanian
resistance
,
which
has
lasted
for
many
decades
,
continues
to
revolt
against
the
extended
international
administration
in
Kosovo
. For
many
ethnic
Albanians
, the
extended
stay
of the
International
Community
in
Kosovo
is
just
another
form
of
foreign
occupation
. As a
result
of this
relationship
,
Kosovo
was, and
perhaps
still
is
, a
source
of
tension
and
instability
for the
entire
Balkan
region
. If the
International
Community
priorities
are to
avoid
calamities
rather
than
wait
for them to
unfold
unexpectedly
, they
must
develop
a
strategy
that will
gradually
replace
the
international
administration
with
Kosovo’s
democratically
elected
officials
.
