Liability
has
become
an
increasing
concern
to
police
officers
. This
study
extended
existing
research
by
expanding
the
definition
of
liability
to
include
internal
discipline
,
criminal
arrests
, in
addition
to
civil
lawsuits
against
police
officers
. The
present
study
assessed
general
perceptions
of
liability
,
effects
of
liability
on
police
performance
,
personal
experience
with
liability
, and
general
beliefs
and
perceptions
concerning
our
current
system
of
justice
.
Particular
attention
was
given
to
high
risk
,
deadly
force
, and
pursuit
situations
. A
survey
was
administered
to a
stratified
random
sample
of
1,621
officers
from
17
police
departments
representing
small
,
medium
,
large
, and
extra-large
size
departments
from
each
of
Connecticut's
8
counties
. A
total
of
343
surveys
were
returned
representing
a
21%
response
rate
. In
general
,
police
officers
reported
little
concern
over
liability
regarding
‘routine
'
daily
police
functions
.
Some
concerns
were
noted
when
deciding
to
use
physical
force
but
few
reported
actually
being
deterred
. A
small
but
notable
minority
of
officers
reported
having
refrained
from
using
deadly
physical
force
. A
significant
concern
over
liability
was
reported
when
involved
in or
deciding
to
pursue
a
motor
vehicle
.
Experience
with
lawsuits
varied
with
nearly
one-half
reporting
that they had been
sued
while
further
reporting
that
most
lawsuits
never
went
to
trial
or were
lost
in
court
.
Few
officers
had been
charged
criminally
regarding
a
work
related
matter
or
believed
that they had been
disciplined
unfairly
. There was
little
variation
among
perceptions
of
administrative
,
criminal
, or
civil
liability
.
Most
officers
reported
that they
did
not
sit
idle
and were not
afraid
to
seek
crime
that was
afoot
due
to
concerns
over
liability
.
However
,
most
also
agreed
that
liability
,
overall
, should be a
concern
for
every
officer
.
